In what is quite literally something we saw coming, the Trump Admin has once again proved that they’re belly up in their hatred for others. According to a brief filed Friday, the administration has sought to ask the Supreme Court to green light a policy that would allow private companies to drop employees for simply being gay.
In fact — this is so far against the law that any attempt by the Trump Administration to actually green light this policy would be one of the gravest violations of the law America has ever seen. Like last week, the governments’ argument surrounds the ridiculous claim that Title VII’s description of ‘sex’ does not directly or even indirectly mention or talk about gay people.
Therefore in the words of the administration, gay people do not have the right to work and therefore must be fired because their are no protections for them. You cannot make this up.
“Title VII’s prohibition on discrimination because of sex does not bar discrimination because of sexual orientation,” said the Justice Department’s brief.
“The ordinary meaning of ‘sex’ is biologically male or female; it does not include sexual orientation,” the filing continued. “An employer thus discriminates ‘because of … sex’ under Title VII if it treats members of one sex worse than similarly situated members of the other sex. Discrimination on the basis of sexual orientation, standing alone, does not satisfy that standard.”
