Texas court grants stay of execution in the death row case of Melissa Lucio

In recent weeks the death row case of Melissa Lucio has captured international attention because of new evidence that appears to suggest she is innocent. Now with the renewed attention Texas ‘s Court of Appeals has ruled that Lucio has been granted a stay of execution which will result in a new trial.

“I thank God for my life. I have always trusted in Him,” Lucio said in a statement shared by her legal team. “I am grateful the Court has given me the chance to live and prove my innocence. Mariah is in my heart today and always.”

Lucio ‘s case stems from the 2007 death of her then toddler daughter Mariah which she has maintained she is innocent of the abuse allegations against her that prosecutors say led to the baby’s death.

Who is Melissa Lucio?

Lucio ‘s case first gained renewed attention after being featured in the show The State of Texas vs Melissa Lucio. Lucio ‘s charges of capital murder came about due to the 2007 death of her daughter Mariah. Prosecutors have long argued that the abuse allegations that were and have been lodged against her were likely part of what led to the toddler’s death.

According to court records, her badly bruised body “in various stages of healing,” her arm had been broken several weeks earlier and she had a bite mark on her back. Lucio ‘s attorneys claim that her death was actually caused by a fall down a steep stairwell inside their apartment complex.
