Sarah Palin ‘s lawsuit against The Times to be dismissed

Sarah Palin has reportedly failed to prove her case against the New York Times as it has been ruled byJudge Jed Rakoff. Rakoff, who is overseeing the case, has decided that ultimately Palin failed to prove a number of key components of the case that would’ve proved The Times in fact violated her as she had claimed.

It appears the case actually referenced the 1964 case of The New York Times vs Sullivan where it was also then ruled that ultimately the person suing must prove that in this instance the Times knew the claim was false (“or acted with disregard for the truth.”)

“I think this [was] an example of very unfortunate editorializing on the part of the Times,” Rakoff said in court Monday according to the New York Times. “The law here sets a very high standard [for actual malice]. The court finds that that standard has not been met.”
